The following are terms of a legal agreement between you the customer and Agile Computer Repairs / Agile Computing. By accessing, browsing and/or using anything on this site and the server it’s hosted on, you acknowledge that you have read, understood, and agree to be bound by the terms below and to comply with all applicable laws and regulations. If you do not agree with these terms, do not use Agile Computing’s services or website.

Repairs

1. Authorisation
The client authorises Agile Computer Repairs / Agile Computing to conduct an evaluation of the machine sent to determine the nature of the damage and provide an estimate of repair cost and timing. The evaluation is free and no work beyond this evaluation will be charged without explicit client approval.

The client authorises Agile Computer Repairs / Agile Computing, its employees, and agents, to receive and transport this media/equipment/data to, from and between their facilities.

Agile Computer Repairs / Agile Computing will only perform physical repairs on equipment outside of a warranty period whether manufacturer or extended. As work of this kind may invalidate any warranty, Agile Computer Repairs / Agile Computing relies on the customer to provide this information before any repair/assessment takes place. In the event Agile Computer Repairs / Agile Computing undertakes a repair under warranty outside of its normal policy it will provide proof in writing before the repair takes place.

2. Legal Rights
The client is the legal owner or authorized representative of the legal owner of the property and all data and components contained therein sent to Agile Computer Repairs / Agile Computing.

Any property left with Agile Computer Repairs / Agile Computing unclaimed for 90 days, will be disposed. At which time, Agile Computer Repairs / Agile Computing shall have no liability to the client or any third party.

3. Limited Liability
Agile Computer Repairs / Agile Computing shall not be liable for any claims regarding the physical functioning of equipment/media or the condition or existence of data on storage media supplied before, during or after service.

In no event will Agile Computer Repairs / Agile Computing be liable for any damage to the laptop/desktop, loss of data, loss of revenue or profits, or any special, incidental, contingent, or consequential damages, however caused, before, during or after service even if Agile Computer Repairs / Agile Computing has been advised of the possibility of damages or loss to persons or property.  Agile Computer Repairs / Agile Computing liability of any kind with respect to the services, including any negligence on its part, shall be limited to the contract price for the services.

The client and Agile Computer Repairs / Agile Computing agree that the sole and exclusive remedy for unsatisfactory work or data shall be at Agile Computer Repairs / Agile Computing option, additional attempts by Agile Computer Repairs / Agile Computing to recover satisfactory data or refund of the amount paid by the client. The parties acknowledge that the price of Agile Computer Repairs / Agile Computing services would be much greater if Agile Computer Repairs / Agile Computing undertook more extensive liability.

The client is aware of the inherent risks of injury and property damage involved in laptop/desktop repair, including without limitation, risks due to destruction or damage to the machine, media, or data and inability to repair the machine or recover data, including those that may result from the negligence of Agile Computer Repairs / Agile Computing, and assumes any and all known risks of injury and property damage that may results.

Confidentiality
Agile Computer Repairs / Agile Computing agrees not to disclose any and all information or data files supplied with, stored on, or recovered from client’s equipment except to employees or agents of Computhouse subject to confidentiality agreements or as required by law.

Payment
For repairs – Payment is due in full upon completion of successful repair, prior to release of the repaired machine (whether shipped, or picked up), unless by special previous agreement. If value of parts exceeds £50 Agile Computer Repairs / Agile Computing reserves the right to ask for a deposit up to 100% of the value of the parts to cover these costs.

For provision of goods or equipment – When payment is due will be specified before delivery of items at time of purchase. This will be either be within 7 days or immediate payment (whether shipped, or picked up), If value of goods exceeds £50 Agile Computer Repairs / Agile Computing reserves the right to ask for a deposit up to 100% of the value of the parts to cover these costs.

Parts and goods provided for sale remain the property of Agile Computer Repairs / Agile Computing until they are paid for in full.

The client is financially responsible for all shipping costs, custom duties and taxes to and from Agile Computer Repairs / Agile Computing.

We accept Cash and Bank Transfers. Cheque’s will be accepted only by prior agreement at discretion of Agile Computer Repairs / Agile Computing.

Warranty
30 days warranty on laptops/desktops that Agile Computer Repairs / Agile Computing has repaired, Agile Computer Repairs makes no warranty on data, express or implied, and Agile Computer Repairs / Agile Computing disclaims any data warranty of any kind.

The parties shall submit all disputes relating to this Agreement (whether contract, tort or both) to arbitration, in accordance with UK business rules. Either party may enforce the award of the arbitrator in a Court of competent jurisdiction. The parties understand that they are waiving their rights to a jury trial. The arbitration shall take place in the Country in which the Agile Computer Repairs / Agile Computing repair centre performing the services is located and the laws of the Country in which such repair centre is located shall apply.

Services Provided

Agile Computer Repairs / Agile Computing will always attempt to provide the best solution for its customers. But cannot be held liable for issues relating to faulty third party software, situations where customer goes against advice or other situations outside of Agile Computer Repairs / Agile Computing control. Where customer wants to use equipment/software or a solution that is against  advice Agile Computer Repairs / Agile Computing can be not held responsible for loss of data or damaged caused. In this situation Agile Computer Repairs / Agile Computing reserve the right to charge extra charge to cover work needed to correct problems that have occured.

Our no, fix, no fee policy

Where offered our no, fix no fee policy means that if the engineer does not possess the necessary technical knowledge or ability to resolve the problem or effect the repair, then no charge is made to the customer.

If the engineer is able to resolve the problem or effect the repair, but is only prevented from doing so by the customer requesting the engineer not to proceed with the work, then the customer may be charged for the engineer’s time spent to that point – i.e. a minimum of 1 hour.

If the engineer is able to resolve the problem or effect the repair, but is only prevented from doing so because the customer does not possess the required (spare) parts, software CD-Rom or Product Key, then the customer may be charged for the engineer’s time spent to that point – i.e. a minimum of 1 hour.

If the engineer provides a clear and precise diagnosis of a failed component and the customer decides not to proceed with the replacement of the component, then the customer may be charged for the engineer’s time spent to that point – i.e. a minimum of 1 hour.

The policy does not apply to work related to data recovery, computer virus or spyware problems or to cases in which the computer has been struck by lightning or so.

All Intellectual Property Rights in or relation to the Products (including any manuals and operating documentation relating thereto) or in any materials (including Software) created by Agile Computer Repairs / Agile Computing during the course of providing the Services shall vest in The Agile Computer Repairs / Agile Computing or its suppliers as the case may be and the Customer shall have no title to or interest in any such Intellectual Property Rights except to the extent specifically agreed by Agile Computer Repairs / Agile Computing.

The Customer will notify Agile Computer Repairs / Agile Computing immediately if it becomes aware of any illegal or unauthorised use of any of the Products or any of the Intellectual Property Rights in the Products and will assist Agile Computer Repairs / Agile Computing and/or its suppliers in taking all steps necessary to defend the owners’ rights.

The Customer undertakes to ensure that any Software which is sold to end-users or any other third party will be accompanied by any Licence Agreement (whether shrink-wrap or otherwise) relating to that Software and any other documentation which Agile Computer Repairs / Agile Computing or Agile Computer Repairs / Agile Computing suppliers may require.

Confidentiality

Each party shall treat as confidential all information obtained from the other which is specifically designated as confidential or proprietary and shall not divulge such information to any person (except to such party’s own employees and then only to those employees who need to know the same) without the other party’s prior written consent.
